This Policy forms an integral part of the Terms of Services(“Terms”) and shall be read harmoniously with the Terms of Use, Refund Policy, Shipping Policy and other consumer-facing disclosures issued by Little Bear as required under applicable law. In the event of any inconsistency between this Policy and the Terms, the decision and interpretation of Little Bear shall be final and binding.

3.1. 9.1. Information shall be retained only for as long as necessary to fulfill lawful business purposes or as required under applicable law. Little Bear may retain anonymized data indefinitely.

12. LIMITATION OF LIABILITY

12.1. Little Bear shall not be liable for any indirect, incidental, consequential, punitive, or economic losses arising from use or inability to use the Platform or from data breaches beyond reasonable control.

13. GOVERNING LAW & JURISDICTION

13.1. This Policy shall be governed by the laws of India. Courts at Mumbai, Maharashtra, shall have exclusive jurisdiction. Disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996.

In compliance with Rule 4(4) of the Consumer Protection (E-Commerce) Rules, 2020, grievances shall be acknowledged within 48 hours and redressed within one month from the date of receipt.

16. COMPLIANCE WITH INDIA DIGITAL PERSONAL DATA PROTECTION ACT, 2023

16.1. Little Bear confirms that it processes Digital Personal Data in accordance with the Digital Personal Data Protection Act, 2023 and rules framed thereunder. For the purposes of the DPDP Act: - Little Bear acts as a Data Fiduciary; - Users act as Data Principals.

16.2. Personal Data shall be processed only for lawful purposes, with valid consent or other lawful grounds.
